Eagle Creek Renewable Energy should be ashamed of themselves.
The owner of a dam that released an estimated 369,000 cubic yards of sediment into the Kalamazoo River during a surprise drawdown, causing an ecological crisis and hampering a long-awaited Superfund cleanup, wants a federal judge to excuse it from a lawsuit because it’s not liable for the actions of its subsidiary.
Eagle Creek Renewable Energy, a Maryland-based hydropower company that owns Morrow Dam in Comstock Township, asked U.S. District Judge Robert Jonker this week to dismiss claims filed against it by the state earlier this month, arguing that the company “plays no part in this case beyond serving as the parent company” for a smaller corporate subsidiary.
